Terms & Conditions

These Terms and Conditions apply to the Spin The Bottle mobile application and related services operated by Olena Gotsulyak (the "Service Provider").

By downloading or using the Application, you agree to these Terms and Conditions.

Use of the Application

The Application is provided for personal entertainment purposes.

You are responsible for how you use the Application and for deciding whether any game prompt, task, question, action, or activity is appropriate for you and the other participants.

Depending on the selected game mode, the Application may contain mature, suggestive, provocative, humorous, or otherwise sensitive content. You are responsible for determining whether such content is appropriate for you and the other participants.

You should not perform any activity that is unsafe, illegal, non-consensual, or otherwise inappropriate. Any participant may refuse or skip a question, task, or activity at any time.

The Service Provider does not control the actions of users or other participants outside the Application and, to the maximum extent permitted by applicable law, is not responsible for injuries, losses, disputes, or other consequences resulting from activities voluntarily performed by users or participants.

Age and Eligibility

The Application is not intended for children under 16 years of age, or any higher minimum age required by applicable law or the applicable application store rating.

You are responsible for ensuring that your use of the Application complies with any age restrictions applicable in your jurisdiction and on the platform through which the Application is distributed.

License

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application for personal, non-commercial use on devices you own or control, subject to applicable application store and platform rules.

You may not copy, distribute, modify, sell, sublicense, reverse engineer, decompile, disassemble, or attempt to extract the source code of the Application, except where such restrictions are prohibited by applicable law or permitted by applicable platform rules.

Intellectual Property

The Application, including its software, design, graphics, text, branding, and other original content, is owned by or licensed to the Service Provider and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of any intellectual property rights to you.

Purchases

The Application may offer in-app purchases or paid features. Purchases are processed through the application store or platform through which they are made, such as the Apple App Store or Google Play.

Purchases may be associated with the store account and platform used to make the purchase and may not be transferable between different platforms or store accounts.

Payment processing, refunds, cancellations, and other purchase-related matters are subject to the applicable application store's terms, policies, and applicable law.

Platform Terms

Your use of the Application may also be subject to the terms, usage rules, and policies of the application store or platform through which you obtained the Application.

If any mandatory application store or platform terms conflict with these Terms, those mandatory terms will apply to the extent required.

Third-Party Services

The Application may use or interact with third-party services, including advertising, analytics, crash reporting, payment processing, application stores, and other technical services.

Third-party services are governed by their own terms and policies. The Service Provider does not control the availability, operation, security, or independent practices of third-party services.

To the maximum extent permitted by applicable law, the Service Provider is not responsible for failures, interruptions, errors, content, or actions of independent third-party services.

Availability and Updates

The Service Provider may modify, update, suspend, discontinue, add, or remove features of the Application from time to time, subject to applicable law and any mandatory platform obligations.

The Service Provider does not guarantee that the Application will always be available, uninterrupted, error-free, or compatible with every device, operating system version, or future platform update.

Some features may require an internet connection. You are responsible for any internet, mobile data, roaming, or other charges imposed by your network provider or other third parties.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Application is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

The Service Provider does not guarantee that the Application will meet your requirements, always function correctly, remain available without interruption, or be free from errors or technical issues.

Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded under applicable consumer protection law.

Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business opportunities, or other intangible losses arising from or related to your use of or inability to use the Application.

To the maximum extent permitted by applicable law, the Service Provider is not responsible for losses or damages resulting from:

• Your use or misuse of the Application
• Actions voluntarily performed during gameplay
• Interactions or disputes between participants
• Failure or unavailability of third-party services
• Loss of network access, device failure, or operating system changes
• Unauthorized access to your device resulting from circumstances outside the Service Provider's reasonable control

Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited.

User Responsibility

You are responsible for maintaining control and security of your device and for using the Application in accordance with applicable law.

You are also responsible for ensuring that other participants understand that participation in the game is voluntary and that they may refuse any question, task, or activity.

Privacy

Information relating to privacy and data processing is described separately in the Application's Privacy Policy.

Termination

You may stop using the Application at any time by uninstalling it.

The Service Provider may discontinue the Application or particular features at any time, subject to applicable law and any rights that cannot lawfully be excluded.

Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, without limiting any mandatory consumer rights or protections that apply to you under the laws of your place of residence.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.

Changes to These Terms

The Service Provider may update these Terms from time to time to reflect changes to the Application, applicable law, third-party services, or business practices.

The updated Terms will be made available through the Application, its store listing, the Service Provider's website, or another reasonable method.
